1. General

1.1 These terms and conditions apply between the person(s) (“Member”/“Members”) registered in the agreement (“Membership Agreement”) and Skimore AS (“Skimore”).
These terms shall be considered an integral part of the Membership Agreement. In addition to the Membership Agreement, the Member shall also be bound by the rules that at any time apply to Skimore’s facilities and other services and offers from Skimore.

1.2 By registering as a member of Skimore, you accept these general membership terms and conditions. If you register on behalf of another person, it is your responsibility to ensure that the participant is aware of these terms and accepts them. By completing the registration, you guarantee that other participants have been made aware of these terms and have accepted them.

2. Membership in Skimore

2.1 Membership in Skimore can be entered into by persons of legal age (18+), who:
(i) Do not have outstanding debts related to previous membership with Skimore.
(ii) Have not previously been banned from one or more of Skimore’s partner centers.
(iii) Have not acted negligently in connection with previous membership with Skimore or other Skimore partners.

2.2 Persons under the age of majority may join Skimore provided a legal guardian enters the agreement. The guardian will be legally responsible for the membership, including all payments related to the membership. Personal data related to such membership will be processed according to our Privacy Policy.

2.3 Membership is valid from the purchase date until the Membership Agreement terminates according to Chapter 9.

2.4 Membership is a recurring agreement with a 12-month commitment. Membership automatically continues for additional 12-month periods until terminated according to Chapter 9.

2.5 Membership gives the Member the right to use the services offered by Skimore as described in Chapter 3. Further, the Member has the right to access available offers according to applicable terms.

3. Description of the Service

3.1 The service is available to the Member immediately after agreement.
Skimore provides access to Skimore Oslo (TryvannWyller AS), Skimore Drammen (Drammen Skisenter AS), and Skimore Kongsberg (Kongsberg Skisenter AS). This includes Oslo Sommerpark at Skimore Oslo and Drammen Aktivitetspark at Skimore Drammen, as well as member offers available at all times.

3.2 The Skimore App allows the Member to manage their profile and pay for two types of membership:
A) Individual membership
B) Family membership

Additionally, the App allows guests to purchase Guest Passes.

3.3 The App communicates with the payment system and Skidata access system at the respective facilities. Skimore can be used at the facilities mentioned in section 3.1.

3.4 Skimore reserves the right to make technical, functional, or other changes to the service as deemed appropriate to ensure the best possible user experience.

4. Prices

4.1 All prices are in Norwegian kroner (NOK) and shown both excluding and including VAT. The total cost will appear before ordering and includes all costs related to the purchase, such as taxes, fees, and delivery costs.

5. Payment

5.1 The Member shall pay the membership fee and any other applicable fees according to Skimore’s current prices. The same applies to guardians or others who have assumed legal responsibility for the membership.

5.2 Payment via debit/credit card is charged immediately. Using direct debit (AvtaleGiro) will result in account deduction approximately 9 days after membership registration.

5.3 If the Member fails to pay on time, a reminder and then a debt collection notice will be issued. Late payment may result in fees and interest according to the Norwegian Debt Collection Act and other applicable laws. Access to the facilities may be temporarily blocked until outstanding amounts are paid (see Chapter 7).

5.4 If a payment has been defaulted and the Member receives a reminder, debt collection notice, or claim from an external debt collector, payment must be made according to the invoice from the external collector.

5.5 In case of non-payment, Skimore may refuse access to membership facilities, and any liability Skimore has under this agreement will, to the extent permitted by law, cease.

6. Disclaimer – Member’s Responsibility

6.1 The Member shall:
(i) Familiarize themselves with and follow all current safety rules and Alpine Safety Guidelines at the facilities. Violations may lead to sanctions as described in Chapter 7.
(ii) Provide correct personal information and a clear photo when creating a membership. All personal data must match a valid ID (passport, driver’s license, bank card, etc.).
A recognizable face photo is mandatory; avatars, animals, or filters are not allowed. Incorrect information may result in inactivation as per Chapter 7.
(iii) In family memberships, only include members living at the same address. Including others may lead to inactivation and fees as per Chapter 7.
(iv) Notify Skimore in writing of changes to contact/payment information (name, address, email, phone, account number, etc.).

6.2 Membership is personal and non-transferable. Misuse of keycards/membership may lead to sanctions under Chapter 7.
6.3 Members must not give others access to Skimore services via shared login information.
6.4.1 Members are responsible for safeguarding their keycard. Suspected misuse must be reported immediately.
6.4.2 Lost/forgotten keycards must be reported to Skimore; a replacement will be issued with an administration fee.

7. Inactivation / Keycard Suspension

7.1 Keycards with incorrect personal information or photo may be blocked until correct information is provided.
7.2 Misuse, including lending keycards to others, will result in inactivation without refund. Keycards may be retrieved by the rightful owner for a fee of NOK 1500.
7.3 Violation of Alpine Safety Guidelines or facility rules may lead to keycard inactivation; retrieval fee NOK 1500.
7.4 Non-payment may temporarily block access until the outstanding amount is paid.

8. Privacy and Marketing

8.1 Card payments are processed by Nets Branch Norway (Org. 996 345 734) or Danske Bank for AvtaleGiro.
8.2 Member data is processed according to our privacy policy and applicable law.
8.3 Skimore may send emails or app messages with offers from Skimore or partners. Members can opt out in the app.
8.4 Skimore may also send information on ski and trail conditions relevant to membership.

9. Termination of Membership

9.1 Membership can be terminated anytime but must cover the minimum 12-month commitment.
9.2 Members will be reminded before renewal; if no notice is given, the membership automatically renews for 12 months.
9.3 Early termination requires payment of remaining monthly fees.
9.4 Skimore may suspend or terminate membership immediately in case of substantial breach, including:
(i) Non-payment despite reminders or debt collection
(ii) Significant breach of Member obligations under Chapter 6

10. Freezing Membership

10.1 Membership can be frozen due to illness or injury during the agreement period. Pre-existing conditions do not qualify.
10.2 Family memberships: monthly fee reduced proportionally.
10.3 Freeze period extends the agreement period by the same duration.

11. Intellectual Property

11.1 All intellectual property related to the membership program, content, and materials belong to Skimore.
11.2 Members may not use or reproduce trademarks or other brand names without prior written permission from Skimore.

12. Right of Withdrawal

12.1 For distance sales (online or phone), consumers may cancel within 14 days after Skimore has fulfilled information obligations, per the Right of Withdrawal Act §20.
12.2 Costs incurred by using the service before the withdrawal period are the Member’s responsibility, per Right of Withdrawal Act §26.
12.3 No right of withdrawal applies for in-store purchases, per Right of Withdrawal Act §1.

13. Personal Injury

13.1 Members use Skimore facilities at their own risk. Skimore is not liable for personal injuries incurred while at or using the facilities.

14. Limitation of Liability, Governing Law, Disputes, and Jurisdiction

14.1 Skimore is not liable for disruptions or restrictions beyond its control (Force Majeure).
14.2 The App may be unavailable due to maintenance, malfunctions, or other circumstances.
14.3 Minor changes to terms may be made annually in October, effective November.
14.4 Membership Agreement is governed by Norwegian law.
14.5 Disputes should first be settled amicably; if not, the ordinary courts have jurisdiction.
