Privacy policy

1 Introduction AS PARKS with subsidiaries, including Skimore AS, Tryvann Wyller AS, Drammen Skisenter AS, Kongsberg Skisenter AS (Skimore Oslo, Skimore Drammen and Skimore Kongsberg), is committed to handling your personal data in a safe and secure manner, in accordance with applicable regulations.

Below you'll find information about how Skimore AS, as the data controller, handles personal data that we collect from users of the Skimore app, as well as the use and hire of our other services (ski hire, ski school, bike hire, use of climbing parks etc.).
This policy also covers Skimore's processing of personal data at the partner facilities Skimore has entered into cooperation with from time to time.

2 What personal data we collect and why?

2.1 Entering into agreements and delivering services
When you enter into a membership agreement with us, or register with us to use our services, we collect personal data from you to complete your order and fulfil our obligations under the agreement with you. These obligations will consist of, among other things, giving you access to the application, identifying you as a valid member, giving you correctly adapted rental equipment, the right level of ski school, and contacting you regarding matters relating to your membership. In this context we process the following personal data: Name, email, mobile number, user photo, date of birth, account details, skill level, size and height.
In a family membership, a mobile number may also be registered on the child's profile where this is required to identify the child at booking or drop-in and to activate member benefits such as free sledge hire and climbing.
The legal basis for this processing is GDPR art. 6 no. 1 letter b (contract). This is because the information is necessary to fulfil the agreement with you.
If the order includes persons who are not of legal age, we also collect this information, provided this is necessary to fulfil the agreement with you. The legal basis for this processing will be GDPR art. 6 no. 1 letter b (contract).
A mobile number may be registered by a guardian when creating the profile, or later if the child shows up to use a member benefit that requires a mobile number in the booking system. The guardian is notified via the contact information in the membership account.

2.2 Registration of activity

We may process information about your visit activity at AS PARKS' facilities to ensure that your use is in accordance with what has been agreed. The legal basis for this processing is GDPR art. 6 no. 1 letter f (legitimate interest).
Furthermore, we may process information about your purchase and visit history in order to tailor which offers we communicate to you. From time to time we offer, for example, conversion of a guest pass to a membership at a favourable price, and we will then tailor our marketing based on who has bought a guest pass. The legal basis for this processing is the Marketing Control Act section 15 (1) and GDPR article 6 no. 1 letter a) (consent).
In addition, we may process anonymised activity data for internal business purposes, for example to (i) allocate revenue between the group companies in AS PARKS, (ii) prepare reports and statistics that we can use to improve our services, and (iii) other types of analysis carried out for the purpose of giving you a better user experience via the app. This processing will, as far as possible, be based on anonymised data that cannot be traced back to you as a person. This type of processing is based on a balancing of interests, as we believe this processing contributes to efficient operation of the company and the best possible terms and services for our customers, cf. GDPR article 6 no. 1 letter f) (legitimate interest).

2.3 Marketing to existing customers and members

Skimore endeavours to ensure that our members and customers receive up-to-date and good information about various updates and other matters we consider relevant so that our customers and members benefit from the services we offer. From time to time we will therefore send out newsletters and other relevant information to all our customers, either via email, push notifications or SMS. These communications may contain information about products and offers that are relevant in connection with your membership or the service you have purchased.
This type of marketing is sent without prior consent to existing customers and members. The communication will be sent to the contact address you provided when entering into the membership. The marketing is based on an existing customer relationship, cf. the Marketing Control Act section 15 (3), and is based on a balancing of interests, cf. GDPR article 6 no. 1 letter f). In cases where you are not an existing customer and member of Skimore, such marketing as described above will be based on the Marketing Control Act section 15 (1) and GDPR article 6 no. 1 letter a) (consent).
If you have consented to this, we may also send you electronic marketing and newsletters containing information about products and services from companies in the same group as Skimore, or about products and services from our commercial partners. The basis for this type of marketing is grounded in the Marketing Control Act section 15 (1) and GDPR article 6 no. 1 letter a) (consent).

We will also disclose personal data to other companies in the same group where this is necessary for internal administrative purposes or is necessary to satisfy group-based governance, control and/or reporting requirements laid down by law. The legal basis for this processing is GDPR art. 6 no. 1 letter f (legitimate interest).
We use the following subcontractors and individuals to:
assist our services; Google Tag Manager, Google Analytics.

These subcontractors process personal data on our behalf and only in accordance with our instructions. In accordance with GDPR article 28, data processing agreements have been entered into with all recipients of your personal data.

4 How long your personal data is stored

We never store personal data longer than is necessary to fulfil our membership agreement or to deliver other services with you. Personal data we no longer need will be permanently anonymised or securely deleted.
When you cancel your membership with Skimore, your personal data will be deleted after 2 years, or when it is no longer necessary for the purpose for which it was collected.
Certain data must also be stored for a specified period in accordance with Norwegian law. This period depends on the type of information and why it is to be stored:
The Bookkeeping Act requires us to keep transaction data for five years.
The Limitation Act means we must keep certain personal data about your customer relationship.

5 Your rights

You also have rights regarding how your personal data is used, including:
The right to object to us processing your data. Here it is important to emphasise that in cases where personal data is requested, such an objection will mean it is not possible to buy or hire the service. The exception is the purchase of a “Guest Card” online. In this case it is possible to buy a card at the till without providing personal data.
The right to request that your data be deleted or that further use of it be restricted.
The right to request a copy of the information we hold about you.
The right to correct, change or update the information you have given us.
The right to contest any kind of automated decisions we make about you. An automated decision is a decision made without human intervention that has legal consequences (e.g. a credit check). We do not normally use automated decision-making, but if we do, we will inform you when such decisions are made.

6 How we store your information

Your information is stored in Skimore's database and Skidata, Wintersteiger (Easy Rent) and Walthard (Ski School). All our solutions are also secured by Cloudflare's CDN and all data here is stored in Google Cloud, except Wintersteiger and Walthard which are stored locally. A limited number of service administrators have access to this data, and all have signed a data processing agreement.

7 How to access and control your information

You can access your personal data in the Skimore app under Profile -> Edit profile.
If you have other questions about the content of this policy, wish to exercise your rights under point 5 or have other enquiries, you are welcome to contact us at personvern@skimoreoslo.no. You also have the right to complain to a supervisory authority, in Norway the Norwegian Data Protection Authority (Datatilsynet), in accordance with GDPR article 13 (2) letter d.
